What changed

Dated, newest first

  1. Cap of 350,000 a year from 1 Dec 2026, rising up to 6% a year; about 800,000 Chinese hybrids expected in 2026; imports about 50,000 a month [2]
  2. Chinese brands held 14% of the EU hybrid and 25% of the plug-in hybrid market in H1 2026, from 2% in 2024; hybrids pay the standard 10% duty [2]
  3. Over 44% of new EU cars registered in August 2026 were hybrids or plug-in hybrids; Lange: not yet a central breakthrough [4]
  4. Reported as a four-year WTO safeguard; such safeguards are usually tariff-rate quotas; in form it applies to imports from all countries; Germany and France pressed for stronger trade defence tools [3]
  5. Joint statement of 8-9 Oct 2026 lists 16 points; point 3 is an understanding on hybrid trade in a WTO-compliant manner; ministerial call January 2027, third round March 2027 [1]
  6. 25 Sep 2026: definitive anti-dumping duties of 40.5% to 67.1% for five years on pea protein from China [7]
  7. Definitive safeguard measures need a qualified majority of 15 states and 65% of the population [6]

Why it matters

On 9 Oct 2026 the EU and China reached an understanding on trade in hybrid vehicles; the Commission put the cap at 350,000 Chinese hybrids and plug-in hybrids a year from 1 Dec 2026, against an expected 800,000 in 2026. Brussels chose a cap over duties of the kind it put on Chinese electric cars in 2024. This risk is that the cap fails and the EU puts duties on every Chinese hybrid.

Why Likelihood 3 Pushes: the 2024 electric-car duties; Germany and France want tougher tools; details unpublished. Brakes: a signed WTO-compliant understanding; reporting says the cap would more than halve imports by Chinese makers; a duty would put the 16-point package at risk.

Why Impact 5 No key price published.

The other facts on file (1)
  • EU duties on Chinese battery electric cars from 29 Oct 2024 for five years: BYD 17.0%, Geely 18.8%, SAIC 35.3%, Tesla 7.8% [5] (29 Oct 2024)

Three scenarios and their signposts

  1. S1

    Cap holds

The safeguard starts on or near 1 Dec 2026 and imports fall towards 350,000.

  2. S2

    Cap stalls

Member states or the Commission delay; imports stay near 50,000 a month.

  3. S3

    Cap breaks

China overshoots or the deal unravels with the wider package, and Brussels opens an anti-subsidy case on hybrids.

The signposts of each scenario
PathSignpost
S1An EU regulation in the Official Journal before 1 Dec 2026
S2No measure at the January 2027 ministerial call
S3A notice of initiation on hybrids

No probability is given for the three paths.

The other side

A cap that holds keeps prices lower than duties would and gives European, Japanese and South Korean hybrid makers room. The cap covers imports, so cars built in the EU fall outside it (Strature's reading), which favours investment in EU plants.
