Why it matters
Ottawa listed the West Coast Oil Pipeline, known as Pacific Link, in Schedule 1 of the Building Canada Act on 1 October 2026. Six days later Cold Lake First Nations asked the Federal Court to quash the listing, saying it was not meaningfully consulted. The challenge the listing invited has already been filed; the question now is whether it stays alive, or succeeds, through October 2027, while the pipeline's regulatory review runs to a target of September 2027.
Why Likelihood 8 Pushes: most consulted communities did not support listing; UBCIC rejected the designation on 1 Oct 2026 and pointed to the courts; reviews and appeals rarely end inside a year. Brakes: settlement, withdrawal, or fast dismissal without appeal.
Why Impact 5 Threshold case: a challenge pending while the review runs.
