Why it matters

Since 24 Jul 2026 UK goods outside Section 232 have paid a 10% US Section 301 duty, the lower of the two tiers USTR set for 60 economies. UK patented medicines pay no extra US duty under Section 232, a country rate the proclamation ties to the UK alone and to the UK's December 2025 drug-pricing deal. Both rates can be raised by notice, but no US threat to do so has been found.

Why Likelihood 3 Pushes: clause 3(f) lets Commerce raise drug rates; US tariff volatility. Brakes: the December 2025 pricing deal and the pledge of no Section 301 case on UK drug pricing this term; the UK's lower tier; a friendly leaders' call on 23 Oct 2026. A driver exists but is blocked. Likelihood scores the Section 301 limb.

Why Impact 4 Threshold case a rise from 10% to 12.5%.

The other facts on file (4)
  • Section 301 notice: 60 economies; 10% tier (ban, partial ban, or reciprocal-deal commitment) and 12.5% for others; from 24 Jul 2026; UK at 10% for a partial regime, not net of MFN; rates appropriate 'at this time' [1] (28 Jul 2026)
  • Proclamation 11020: UK patented medicines 10%, reduced to zero to the extent required by a pricing deal; EU, Japan, South Korea, Switzerland 15%; applies from 31 Jul 2026 (Annex III companies) or 29 Sep 2026 (others); clause 3(f) allows increases [2] (2 Apr 2026)
  • 1 Dec 2025 deal: UK net prices for new medicines +25%; VPAG 15%; no US Section 301 case on UK drug pricing during this presidential term [5] (3 Dec 2025)
  • USTR stated the UK deal had been finalised [6] (6 Apr 2026)

How it spreads

If

Between 26 Oct 2026 and 25 Oct 2027, the US raises the Section 301 rate on products of the United Kingdom above 10%, or raises the additional Section 232 duty on UK patented medicines above zero, by a notice in force for at least one day.

Channels 4 on the card

  1. CanadaNo Canadian loss sourced; Canada's C$9.95bn of UK imports in 2025 [8] are not touched.
  2. UK exportersA move from the 10% tier to the 12.5% tier adds 2.5 points on goods outside Section 232 [1].
  3. UK drug exports and the NHS dealEnding the zero rate removes the main gain the UK took for higher NHS drug prices.
  4. Trade policyThe 10% tier [1] and the pricing deal [5] would no longer be floors.

Who is exposed

Three scenarios and their signposts

  1. S1

    Steady

    Both rates hold.

  2. S2

    Tier shift

USTR revisits the tiers and moves the UK to 12.5% over its partial forced-labour regime.

  3. S3

    Drug clawback

Washington finds the UK short on prices or rebates and uses clause 3(f).

The signposts of each scenario
PathSignpost
S1No USTR or Commerce notice on the UK by mid-2027
S2A USTR review of forced-labour commitments
S3A US complaint on NHS prices or VPAG

No probability is given for the three paths.

The other side

The UK holds the lowest US country rate for drugs in the proclamation [2][3] and the lower Section 301 tier [1]. That leaves UK-made medicines cheaper to ship to the US than EU, Swiss or Japanese ones.
