Impact is the average of the four parts, rounded, plus one point when Canada is directly hit on two or more channels, up to 10.

Two separate scales from 1 to 10. Strature never multiplies or merges them.

What changed

Dated, newest first

  1. Poland brought an annulment action under Article 263 TFEU on 10 May 2026, with a request for suspension [10]
  2. Court's Vice-President dismissed Poland's request to suspend the Council decision on 29 Sep 2026 (no serious and irreparable damage shown); main action pending [10]

Why it matters

The EU-Mercosur interim trade agreement has applied provisionally since 1 May 2026 while Parliament's request for a Court opinion (1/26) and Poland's annulment action (C-460/26) are pending. On 29 Sep 2026 the Court's Vice-President dismissed Poland's request to suspend the deal, so it keeps running unless a ruling on the merits goes against it. EU-Mercosur goods trade was about EUR 109bn in 2025 (Strature's sum).

Why Likelihood 3 Two cases are pending, a live driver, held by strong blockers: suspension was refused on 29 Sep 2026, an opinion may take one to two years, a negative opinion bars entry into force rather than provisional application as such, and the Council would still need to act.

Why Impact 5 The EU and four Mercosur states; EUR 109.4bn (Strature's sum; about US$122bn) of 2025 goods trade, partly repriced (estimate); one to three years until amendment. Trade continues on earlier terms.

Three scenarios and their signposts

  1. S1

    The deal stands

The Court finds the agreements compatible, or the cases run past the window.

  2. S2

    Amend and carry on

A negative opinion on one point leads the Commission to propose changes while provisional application continues.

  3. S3

    Halt

A negative opinion or annulment leads the Council to suspend provisional application.

The signposts of each scenario
PathSignpost
S1a hearing date in case 1/26 set after mid-2027
S2an Advocate General's opinion in 1/26 that questions a named clause
S3a Council agenda item on suspending the iTA
